Statement from TWU Local 100

The union announced this week that Richard Davis has resigned from his position as President of TWU Local 100. In his resignation letter, Mr. Davis cited health reasons for his departure.

After consulting with our attorneys, the Union can now officially share the following information:

  • TWU International President John Samuelsen suspended Mr. Davis upon learning of accusations of alleged sexual misconduct. In connection with those allegations, the International Union filed internal charges against Mr. Davis.
  • Our public restraint regarding this matter stems from the potentially serious legal ramifications and privacy concerns for the accuser—rather than any conspiracy theories to conceal the truth from you.
  • It is important to know the elected leadership is in control of Local 100. We continue to operate autonomously and with the full support and partnership of our International, the Transport Workers Union of America.
  • Local 100’s Executive Committee, consisting of the top Officers and all Department Vice Presidents, has unanimously voted that John V. Chiarello, the elected Financial Secretary-Treasurer, will oversee the Local’s day-to-day affairs on an interim basis.
  • We are now moving forward and laser focused on upholding the great legacy of this proud Union, restoring confidence within our membership, and re-centering “fightback” as the leadership mantra of Local 100.
  • In accordance with our bylaws, our Executive Board will appoint a President at its next scheduled meeting in February

***Richard Davis statement on Governor  Hocul’s Safety Initiatives

Gov. Hochul’s announcement to put police officers on every overnight subway train is a win for common sense and safety. Transit workers have been saying for years: the system needs better protection—not just for the millions of riders but for the men and women who keep it moving 24/7.

Our members face the realities of the subway system every single day. They’ve been threatened, harassed, and attacked, all while doing their jobs. This plan, which focuses on increasing police presence during the overnight hours, is the kind of action we’ve been demanding. It’s a step in the right direction.
 
But this is not the finish line. We need more than a six-month trial. We need sustained and serious investment in safety—not just in the overnight hours but across the system, all the time. TWU Local 100 will keep fighting to make sure that happens.
 
We’re glad to see Governor Hochul taking our concerns seriously. Now we need the MTA and all decision-makers to step up and meet the same standard of urgency. As we have heard countless politicians and state and city officials acknowledge: Transit Workers are the lifeblood of this city, and their safety is non-negotiable.

***Sick Policy***

1- Sick Call-You must call in at least one(1) hour before your run is due to report
2- Change of Location- You must call the crew dispatcher whenever you leave the house and upon return. If out for two (2) hours at a time you must make another call to the crew dispatcher. Each two (2) Hours out.
3- Sick Forms – Must be turned in to General Dispatcher within three (3) days of your return to work. No matter how long you are on Sick.
4- Doctors certification- Make sure that your Doctors Lines are completed correctly. Do not alter the doctor’s lines ever.
5- Clearing- Clearing yourself from Sick Leave clear yourself as soon as possible.
6- If an operator has less than 50% of sick time in the bank the operator is subject to a check for Patterns.
7- Undocumented Sick- After 5 undocumented sick in a rolling year you will be counseled. The 6th undocumented in the same rolling year will put you on Sick Leave Control List.5
